BE CLEAR MEDIA (Gatasi Real Estate Group LTD.) - TERMS AND AGREEMENTS

By engaging with any of our services, you are entering into a contract governed by the following terms and conditions:

Agreement:

• When you utilize Be Clear Media - Gatasi Real Estate Group Ltd. services, you are bound by the terms outlined herein.

• It is your responsibility, as the Client, to thoroughly read and understand these terms and conditions before proceeding with any of our services.

Copyright:

• All creative material, including but not limited to photographs and videos, supplied to you by Be Clear Media - Gatasi Real Estate Group Ltd. remains the intellectual property of Gatasi Real Estate Group Ltd.

• The duration of the license is for the length of the current transaction and is used to promote the current transaction of the property.

• Re-listing the property after the transaction has occurred requires a new license.

• Images cannot be resold or transferred to any third party; including but not limited to new listing agents, trades, designers or services without written consent from Be Clear Media - Gatasi Real Estate Group Ltd.

• Amenities, exteriors, and location shots are licensed for one transaction and must be relicensed if used for another transaction.

• The license is only valid from the time full-payment for services have been made.

• Be Clear Media - Gatasi Real Estate Group Ltd. may use photos or videos for its promotional material at any time.

• Subsequent usage for promotion outside of the translation of the property of any media provided by Be Clear Media - Gatasi Real Estate Group Ltd. requires a separate licensing agreement and an additional fee.

Additional Usage in Case of Termination and New Listing Agent Appointment:

In the event that the original listing agent is terminated and a new listing agent is appointed to the property, specific guidelines must be followed regarding the usage of previously provided media. With the explicit permission of the terminated listing agent, Be Clear Media - Gatasi Real Estate Group Ltd. will relicense the existing media to the new listing agent at the full original price.

This process ensures that the new listing agent can legally and ethically utilize the media for their marketing efforts while respecting the rights and contributions of the terminated agent. As a measure of fairness and to acknowledge the original agent's investment, 50% of the relicensing fee will be refunded to the terminated listing agent.

By adhering to these terms, Be Clear Media - Gatasi Real Estate Group Ltd. maintains the integrity of our licensing agreements and ensures equitable treatment for all parties involved in the property transaction.

Unauthorized use or distribution of Be Clear Media’s media will result in an additional copyright infringement fee of $200 if the images are found online without proper licensing or permission.

Estimates:

• The fees quoted by Be Clear Media - Gatasi Real Estate Group Ltd. are based on the original job description provided by you, the Client.

• Any changes to the scope of work may result in additional charges.

• Additional work not included in the estimate or price sheet will be billed at a rate of $110 per hour.

Payment:

• Be Clear Media - Gatasi Real Estate Group Ltd. accepts the following forms of payment: credit card, cheques, and e-transfers. We do not accept cash.

• Payments are required to be made within 5 days (net 5) after the invoice has been issued.

• A late fee of $50 will be applied if payment is not received within 24 hours after the 5-day period.

• For every additional 30 days the payment is overdue, an additional late fee of $50 will be charged, along with an interest rate of 2% per 30 days.

• Licenses for our products will not be granted until payment has been received in full.

Late Arrival :

• A fee of $80 dollars will be billed for any appointment where access isn't granted within 30mins of our appointment time.

Cancellation / Rescheduling:

• We kindly request as much notice as possible for any cancellations or rescheduling.

• If a cancellation or rescheduling occurs within 24 hours of the scheduled appointment, a $100 cancellation fee will be charged.

• It is the responsibility of the agent to monitor weather conditions and plan accordingly. If specific weather conditions, such as a sunny day, are required, the agent is responsible for rebooking the appointment.

• Cancellations or rescheduling made onsite or within 2 hours of the scheduled appointment will be billed at half of the quoted amount.

Home Preparation:

• It is essential that the home is prepared for photography or filming upon the photographer's arrival. Please refer to our Photography Preparation Checklist for guidance.

• Homes will be photographed "as is" if they are not prepared. If the property is not ready, the photographer will proceed with the shoot as scheduled. Should the Client desire a return visit after the property is ready, a rebooking will be necessary.

• Please note that Be Clear Media does not offer cleaning or staging services. We are committed to capturing your property in its best light, but extensive preparation and staging are the responsibility of the Client.

• For minor adjustments and alignments, our photographers will make small preparations (under 10 minutes) at all properties.

• If the home is not ready and time permits, we will make our best efforts to support the agent. However, it is not our responsibility to ensure the property is in a shoot-ready condition.

• Any waiting time, cleanup, or additional staging assistance beyond the minor adjustments will be charged at $100 per hour and added to the invoice.

Onsite Services:

• Onsite services, such as photography and videography, typically take between 30 minutes and 3 hours, depending on the property size and the service chosen.

• While we love pets, we ask that they be removed from the property or contained in a room that will not be photographed.

• For owner-occupied units, we request that only the photographer and agent be present during the shoot. Minimizing the number of people on-site helps us deliver our best service.

• For tenanted units, we ask that the landlord or agent be present for the photo shoot.

Delivery / Archival:

• Photos will be delivered within 24 hours, by 5pm the next day. Twilight photos will be delivered within 24 hours if the twilight shoot is completed before 8pm.

• Floor plans will be completed and delivered by 7pm the following day.

• Videos will be completed within three to four days of the shoot, not including revisions. Revisions will be completed within 24 hours of the request.

• Media will be hosted for three months after final deliverables are handed over. Raw files will be stored for 3 months.

• Be Clear Media is not responsible for archiving final deliverables beyond these timelines. It is the client's responsibility to store and manage their media files after the specified archival period.

Floorplan Disclaimer:

We take great care to ensure that the floor plans we create for our clients are as accurate as possible. However, due to various factors that may affect the measurements, we cannot guarantee that our floor plans will be an exact representation of the property. Therefore, we advise our clients and representatives of the property to carefully review the floor plans we provide and compare them to the actual measurements of the property before uploading them to any public websites or forums, including but not limited to the MLS.

Be Clear Media - Gatasi Real Estate Group Ltd. shall not be held responsible for any discrepancies in the measurements of the floor plans we provide, and we will not be held accountable legally. We strongly recommend that our clients and representatives of the property seek professional advice and perform their due diligence in verifying the accuracy of the floor plans before using them for any legal purposes, including but not limited to, selling or leasing the property. By using our services, clients and representatives of the property acknowledge and accept this disclaimer.

Liability and Indemnification:

Clients assume all risk for damage and loss resulting from the preparation, assembly, use, and operation of Be Clear Media - Gatasi Real Estate Group Ltd. products and services. Clients agree to release Be Clear Media - Gatasi Real Estate Group Ltd. from all liability for any damage or loss resulting from the use of the products and services. Clients will indemnify and hold Be Clear Media - Gatasi Real Estate Group Ltd. harmless against any and all liabilities, claims, and expenses, including legal fees, arising from the preparation, assembly, use, and operation of the products and services, as well as from any injury to person or property resulting from these activities.
